Access to and use of this Website and the products and services available through this Website (collectively, the “Services”) are subject to the following terms, conditions and notices (the “Terms of Service”). By using the Services, you are agreeing to all of the Terms of Service, as may be updated by us from time to time. You should check this page regularly to take notice of any changes we may have made to the Terms of Service.
You the customer agree that all transactions between the customer and Software Empire will be subject to these terms, including but not limited to future transactions made verbally, by email, in person, or any other method of conducting business
We provide a guarantee that the products we resell are legitimate and in good working order. We will honor this guarantee for 30 calendar days from the purchase date. In some cases we may extend the period of this warranty solely at the discretion of Software Empire. If the product does not work correctly, we will offer a replacement product or remedy. If we cannot fix the problem, we will provide a full refund to the customer. Due to the nature of the products we sell, we cannot grant returns/refunds due to orders placed by mistake, products purchased in error, or a change of mind. Once customer receives a license, the license cannot be be resold by us again and therefor cannot be returned for a refund. In some rare cases, when a refund is approved, a 20% restocking fee or in store credit may be applied. While our tech support team will make every effort to help you install software purchased from us, we are not liable for computer error on customers side or compatibility issues.
In some cases, our automated system will authorize payment for your order and will place the order on hold for review. This is done for the security of our customers in an effort to decrease credit card fraud. When this happens, it will be necessary for a Software Empire employee to manually review an order and investigate it. Once the review is complete and approved, the customer will receive license keys (if applicable). The review process usually takes no more than a few hours but may take up to 48 hours in some cases. Customer agrees that Software Empire will not be held liable for any loss incurred by this process should it be necessary.
Should litigation be initiated by any party related to the services performed or goods sold by company to the customer or to collect fees related to such services, the prevailing party shall be entitled to reimbursement from other party for any attorneys fees and court costs whether suit be filed or not and through all appeals. Venue for any such litigation shall be in Pinellas County, Florida.
In most cases Software Empire will provide instant delivery of software download and/or license information to the customer after checkout. Under certain rare conditions, customer will not receive instant delivery of product and will need to wait up to three (3) business days for delivery. Product delivery delays can be due to incorrect billing address information, incorrect credit/debit card information, security screening system flagging an order, or a temporary shortage of product stock.
In some cases a product may become unavailable due to a shortage in stock. When this happens our automated system may automatically upgrade customer to the next comparable version of the product you are purchasing. Example, Office Home & Business may be upgraded to Office Professional.
You (the customer), agrees that before initiating any chargeback, credit card dispute, or bank dispute for services performed or goods sold, will then notify company in writing that a dispute or complaint exists and shall provide company with a reasonable amount of time to cure any valid complaint (up to 10 business days). Failure to comply with this provision will void any warranties of merchantability or fitness for a particular purpose or any other state or federally mandated warranties, if any. If customer does submit a chargeback, credit card dispute, or bank dispute for services performed or goods sold before giving company a reasonable amount of time to resolve complaint, customer agrees to pay Software Empire the amount of order plus up to a additional $50 chargeback fee.
Access to this Website is permitted on a temporary basis, and we reserve the right to withdraw or amend the Services without notice. We will not be liable if for any reason this Website is unavailable at any time or for any period. From time to time, we may restrict access to some parts or all of this Website.
